ae e- A-,-(ie -'ES <br /> 4/6 8'-b 3/S' <br /> r fa <br /> o Y <br /> Re: IVIS-98-23, 780 East Agusta Street Woodbridge <br /> In response to your request, this letter has been generated to clarify the Division's <br /> stance with regards to the well present on this property and to assist you with the <br /> process to destroy this well. Our initial concerns were noted on the July 7, 1998, MS-98- <br /> 23 review. The San Joaquin County Development Title Requirements noted on the <br /> review still apply, per the following applicable Sections: <br /> 9 - 1115.2 PUBLIC WATER SYSTEM CONNECTION REQUIRED. Private, on site <br /> domestic water wells shall not be approved where public water systems are available <br /> pursuant to Chapter 9 — 1120. <br /> 9 -1115.8 PROHIBITED USES, (b) Separate Wells. The provision of water to a <br /> residence from an off-site private, domestic water well located on a separate recorded <br /> parcel. <br /> 9 — 1120.4 RURAL COMMUNITIES, Within rural communities, water supply shall be <br /> provided as follows: <br /> (b) Subdivisions with parcels less than two acres shall be served by a public water <br /> system. <br /> (c) Development projects on existing parcels shall be served by a public water <br /> system if a water main is within two hundred (200) feet of the nearest property <br /> line. Exceptions maybe granted by the Director of the Public Works if the Director <br /> determines that the existing system has no capacity or the parcel cannot be <br /> annexed to the existing water district. If an existing water main is not within two <br /> hundred (200) feet, the development project may use an on site well subject to <br /> the provisions of Section 9 -1120.2 <br /> The Division's concern with a well supplying more than one parcel, is the potential for <br /> the well water to be contaminated. This well is not under any jurisdiction for monitoring <br /> as the well belongs to the owner of the parcel on which it is located. Bacterial and/or <br /> chemical contaminates maybe present and unknowingly consumed. Based on this issue <br /> and the San Joaquin County Development Title, the Department approved this parcel <br /> A Division of San Joaquin County Health Care Services <br />
