CONDITIONS OF APPROVAL <br /> MS-98-25 <br /> Dungan Family Trust <br /> Minor Subdivision Application No. MS-98-25 was approved by the San Joaquin County <br /> Community Development Department on September 2, 1998. The effective date of approval is <br /> September 12, 1998. This tentative map approval will expire on September 11, 2001, which is <br /> three years from the effective date of approval, unless (1) all Conditions of Approval have been <br /> complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be <br /> fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number <br /> have been identified as Ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Kai Luoma, 468-9567) <br /> a. MERGER: All parcels which compose Parcel 1 on the Tentative Map shall be merged prior <br /> to approval of the map. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcel 2 shall be between two (2) net acres and five (5) gross acres in size. <br /> (Development Title Section 9-610.3[aj) <br /> C. NOTICE OF NON-RENEWAL: A Notice of Non-renewal for all parcels below the ten (10) <br /> acre minimum parcel size will also be initiated by San Joaquin County in conjunction with the <br /> contract. A fee for the recording of the Notice of Non-renewal is required. <br /> d. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of <br /> Minor Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a <br /> reference to the instrument number of said recorded notice, stating that: <br /> (1) The homesite shall not be transferred separately until September 11, 2011, <br /> or upon the death of an owner owning at least fifty(50) percent interest in the <br /> homesite parcel. <br /> (2) The property shown on the Parcel Map is restricted from further subdivisions <br /> for homesite purposes, except for financing only, by Section 9-610.3 of the <br /> San Joaquin County Development Title. <br /> e. ACCESS: The following access requirements apply and shall be shown on the Parcel Map: <br /> (1) A proposed 25-foot-wide private easement for access to Parcel 1, along Parcel 2, <br /> shall be shown on the Parcel Map.
