CONDITIONS OF APPROVAL
MS-98-27
Thompson
Minor Subdivision Application No. MS-98-27 was approved by the San Joaquin County
Community Development Department on September 4, 1998. The effective date of approval is
September 14, 1998. This tentative map approval will expire on September 13, 2001, which is
three years from the effective date of approval, unless (1) all Conditions of Approval have been
complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor.
Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be
fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number
have been identified as Ordinance requirements pertinent to this application. Ordinance
requirements cannot be modified, and other Ordinance requirements may apply.
1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Chandler Martin, 468-3144)
a. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map:
(1) Parcel 1 shall have a minimum lot width of 150 feet. (Development Title Section 9-
310.4)
(2) Parcel 1 shall have a minimum lot area of 2 net acres. (Development Title Section
9-310.3/9-1105.2[d][6])
b. LANDSCAPING: Landscaping shall be provided and comply with the following:
(1) Street trees are required as specified in Section 9-1020.4 of the Development Title.
2. DEPARTMENT OF PUBLIC WORKS: (See the attached memo dated August 20, 1998.)
3. PUBLIC HEALTH SERVICES: (See the attached memo dated August 5, 1998.)
4. COUNTY COUNSEL:
a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code,
the subdivider shall defend, indemnify, and hold harmless the local agency or its agents,
officers, and employees from any claim, action, or proceeding against the local agency or its
agents, officers, or employees to attack, set aside, void, or annul an approval of the local
agency, advisory agency, appeal board, or legislative body concerning a subdivision, which
action is brought within the time provided for in Section 66499.37 of the Government Code.
5. DEPARTMENT OF PARKS AND RECREATION: (Staff Contact: Jeff Smith, 953-8800)
a. PARK FEES: Due to the relatively small size of the subdivision, less than fifty (50) parcels,
the San Joaquin County Department of Parks and Recreation will require the collection of in-
lieu fees for park development as a requirement for approval of the Map. (Development Title
Section 9-1230.8)
