j . The topsoil shall be set aside, and upon completion of an <br /> excavation, the topsoil shall be replaced and the site <br /> leveled in conformance with the excavation permit <br /> (Section 9-2244 (1) ) . <br /> k. Slopes shall not exceed two feet horizontal to one foot <br /> vertical. <br /> 1. The applicant shall pay a fee to the County of San <br /> Joaquin to cover the cost of periodic inspection of the <br /> excavation to ensure compliance with the provisions of <br /> the permit and administration of SMARA requirements <br /> (Section 9-2244 (s) ) . <br /> M. A performance guarantee, payable to San Joaquin County <br /> and the State Geologist, shall be required to ensure <br /> rehabilitation of the site and compliance with conditions <br /> of approval. The estimated cost of rehabilitation shall <br /> be reviewed by the Department of Public Works. The type <br /> of guarantee proposed by the applicant must be found <br /> acceptable by County Counsel. The type of financial <br /> guarantee may be, but is not limited to, the following: <br /> (1) A Surety Bond. <br /> (2) A Trust Fund. <br /> (3) An Irrevocable Letter of Credit. <br /> n. Dikes shall be constructed around areas under excavation <br /> outside of the expansion pit. Water shall be directed by <br /> pipe or ditch to and from settling ponds. Construction <br /> of dikes shall be subject to approval by the Department <br /> of Public Works and the State Water Quality Control Board <br /> and shall be designed to prevent erosion, siltation, and <br /> water runoff from the site. <br /> o. A clearance permit shall be required from the Army Corps <br /> of Engineers prior to discharging fill material into <br /> drainages, wetlands, or vernal pools. <br /> 2 . DEPARTMENT OF PUBLIC WORKS: <br /> Ordinance Requirements: <br /> The Ordinance Requirements listed below have been identified <br /> as pertinent to this project. Other Ordinance Requirements <br /> may also apply. Ordinance Requirements cannot be modifified. <br /> a.
