FEDERAL REGULATORY PERMIT REQUIREMENTS <br /> AUTHORITY <br /> Occupational Safety None required; <br /> and Health inspections <br /> Administration <br /> (OSHA) <br /> A Conditional Use Permit, as approved by the San Joaquin County <br /> Planning Commission, would allow E1 Rancho Rock and Sand, Inc. to <br /> continue to develop quarrying operations at the E1 Rancho facility. <br /> The permit would specifically not allow activities at the site <br /> other than those activities defined in the application. <br /> Before approval of the Conditional Use Permit, the County may <br /> require El Rancho Rock and Sand, Inc. to adopt mitigation measures <br /> as proposed in this document, as proposed in the application, or as <br /> otherwise determined necessary, as conditions of approval of this <br /> project. Because this proposed project is consistent with County <br /> Zoning and General Plan provisions, no other land use approval is <br /> required. Since the issuance of a use permit is not quasi- <br /> legislative, the Board of Supervisors need not act on the <br /> application unless the Planning Commission's decision is appealed. <br /> A Reclamation Plan must be submitted concurrently with the <br /> Conditional Use Permit application. <br /> Any person proposing to construct or modify a facility that emits <br /> pollutants from a stationary source must obtain an Authority to <br /> Construct prior to proceeding. The San Joaquin County Air Pollution <br /> Control District will issue an Authority to Construct and Permit to <br /> Operate to El Rancho Rock and Sand, Inc. for the proposed project <br /> expansion. In addition, this agency may conduct inspections of the <br /> facility for compliance with the permit. <br /> The California Department of Fish and Game may require a Stream <br />' Alteration Agreement for the installation of culverts beneath the <br /> existing check dam across the lowlying drainage course and wetland. <br /> Although the Stream Channel Alteration Act provides that no <br /> operation or activity which will alter a stream channel. may be <br /> undertaken without authorization, recent policy changes have <br /> dictated that only those activities which will have a substantial <br /> impact must be permitted. In the recent past, the Department has <br /> not required a permit for a culvert crossing over a small or <br /> intermittent stream. <br /> The operator of any facility which discharges waste that may affect <br /> groundwater quality or from which waste may be discharged in a <br /> diffused manner (erosion from soil disturbance) must first obtain <br /> Waste Discharge Requirements. The Regional Water Quality Control <br /> Board will review the Report of Waste Discharge and determine the <br /> CONDOR <br />
