If the property is sold, the mobilehome is to be removed from the <br /> property. <br /> Finding: The property is in intensive farming. <br /> ------------------------------------------------------------------------------- <br /> DIRECTOR'S REPORT <br /> A letter was received from Mr. Roger Sitkin concerning the Ross Purviance <br /> Excavation Permit . " The property is being excavated under the operation of <br /> Stockton Sand and Gravel. Mr. Sitkin requested a revocation hearing. <br /> Mr. Thanas said that Mr. Sitkin was present for this discussion and staff <br /> contacted Stockton Sand and Gravel to inform them of this discussion. <br /> Roger Sitkin, 8008 Waverly Road, Linden, was present and said he manages the <br /> property on which the Stockton Sand and Gravel is operating. That property <br /> belongs to his grandmother. He showed slides to illustrate dumping and <br /> burying of trash on the property. He stated the dumping is in violation of <br /> the ordinance. Asphalt has been dumped near the Calaveras River. He noted <br /> there is a violation of condition #7 of the permit which required a 50' wide <br /> levee. Stockton Sand and Gravel has not acquired a new streambed alteration <br /> permit for the excavation permit. The operator has not submitted an adequate <br /> rehabilitation plan to the Department of Fish and Game and Mr. Sitkin said <br /> he did not believe that department will issue a new permit. lie said there <br /> has been significant removal of top soil; 10,000 to 20,000 yards of prime <br /> agricultural loam were removed and this included an area of mature oak trees. <br /> He said that condition #5 is in violation. He said a serious concern is the <br /> lack of rehabilitation of the site. The slopes have not been re-seeded. <br /> Mr. Sitkin asked for revocation of the existing permit. <br /> Attorney Mark Adams, representing Stockton Sand and Gravel, was present and <br /> said that some of the slides shown were not of the property which is under <br /> lease with the grandmother. Only this last spring, Mr. Sitkin negotiated <br /> another lease for the property for further excavation. Mr. Adams said that <br /> no notice was given to Stockton Sand & Gravel that they are in violation of <br /> the permit. The asphalt was dumped on the property over 20 years ago and <br /> there has not been anything further since that time. Staff has monitored <br /> the situation and they have not found that the violations were of significant <br /> concern to warrant revocation. <br />
