I . INTRODUCTION <br /> Stockton Sand and Gravel has been operating a gravel <br /> quarry on the Calaveras River approximately eight miles east of <br /> Linden for more than 20 years. Stockton Sand- and Gravel is a <br /> corporation owned by Mr. Don Merian and Mr. James Kovack. <br /> Air. Merian is the operator and manager of the quarry operations. <br /> Mr. Merian now seeks a Permit for Stockton Sand and Gravel to <br /> move its operations from the Calaveras River project site to a <br /> site on Waverlv Road, approximatelv one mile to the east. <br /> The track record of Stockton Sand and Gravel and Mr. Merian <br /> should be carefully examined in light of the request for a hew <br /> Permit. It is the belief of the authors of this report that the <br /> facts contained in this report rea;ardi.ng Mr. Merian' s practices, <br /> coupled with cognizance of the County' s inability to enforce <br /> compliance with Conditions contained in existing and prior Permits, <br /> cause a conclusion that the County cannot afford to seriously <br /> consider granting another Permit to Mr. Merian until it finds an <br /> effective means of enforcing the existing Permit conditions. <br /> mr. Merian' s disregard for conditions of the present Permit on the <br /> Calaveras River and many of this actions already in the proposed <br /> excavation site demonstrate his contempt for regulatory restriction. <br /> The County has already incurred substantial responsibility <br /> to assure that Stockton Sand and Gravel performs in compliance with <br /> the existing Permit; since numerous violations to the Permit exist <br /> at this time , it seems ludicrous to consider granting any new <br /> Permit without first resolving the violations of the existing <br /> Permit. <br /> Beyond the track record of Stockton Sand and Gravel on the <br /> Calaveras River project site, already Mr. Merian ' s activities on <br /> the proposed new site are in violation of State and County require- <br /> ments. The proposed operations at the Waverly Road project site <br /> contain many hazards to health and safety, as well as potential <br /> environmental and ,economic degradation. This report contains facts <br /> regarding Stockton Sand and Gravel ' s performance and plans on the <br /> proposed site and recommendations regarding protections for the <br /> County and the residents of the area. <br /> Roger Sitkin represents the property owner of the <br /> Calaveras River project site as the on-site property manager; the <br /> property is owned by Mrs. Dorothy Cady, grandmother of Roger Sitkin. <br /> He has worked with various County and State agencies over the years <br /> to attempt enforcement of the existing Permit and he has attempted <br /> enforcement through lease provisions. Roger Sitkin' s position has <br /> caused him to become well-informed of Mr. Merian ' s operating <br /> practices and his actions with respect to the Permit. <br /> Roger and Barbara Sitkin reside at 8008 N. Waverly Road, <br /> Linden, California. Their residence is located only 135 feet from <br /> areas of proposed excavation under the proposed Permit. <br />
