Box 66002 <br /> Stockton, CA 95206 <br /> NOTICE OF VIOLATION <br /> UNREGULATED DISCHARGE, EL RANCHO ROCK & SAND, INC. , 8000 WAVERLY ROAD, LINDEN, <br /> SAN 70AQUIN COUNTY <br /> We inspected your facility on 21 February 1990 (see attached memorandum) in <br /> relation to your application to the county to expand your excavation area, under <br /> an existing county Excavation Permit (EP 81-9) . Your application states that <br /> all water is contained. This is not what we observed during our inspection. <br /> There was a significant amount of silty wastewater being discharged to natural <br /> drainages, tributaries to Mormon Slough. You are discharging in violation of <br /> Section 13264 of the California Water Code by not filing a Report of Waste <br /> Discharge (RWD) and discharging without a permit. <br /> We require you to operate your facility without adversely impacting water <br /> quality, and to complete the enclosed RWD and provide the additional information, <br /> and return them with an annual filing fee of $100 to our office. The RWD shall <br /> also include a wastewater management plan which shows how water quality will be <br /> protected. We will check it for completeness, request additional information <br /> if necessary, and draft waste discharge requirements. Prior to any expansion <br /> of your operation, you must show you can manage your existing wastewater <br /> adequately. <br /> Please submit the RWD, additional information, and filing fee to us by <br /> 8 June 1990.
