EP-81-9 OF <br /> ROSS PURVIANCE TO REVIEW THE ANNUAL PERMIT COMPLIANCE <br /> REPORT AND TO CONSIDER MODIFICATION OF THE CONDITIONS <br /> OF APPROVAL <br /> ---------------------------------------------------------------- <br /> RECOMMENDATION: <br /> Staff recommends that the Planning Commission: <br /> 1 . Approve a Negative Declaration and direct the Clerk to file a <br /> Notice of Determination; and <br /> 2 . Modify Conditions of Approval No. 4, 5 , 9, 10, 11 , and 14; <br /> and delete Conditions of Approval No. 19, 23 , and 24(g) , as <br /> noted in the staff report . <br /> BACKGROUND: <br /> Quarry Excavation Permit No. EP-81-9, as revised in January 1985 <br /> by the Planning Commission, was approved for a site located on <br /> the east side of Waverly Road, approximately one-half mile south <br /> of Shelton Road, east of Linden. Condition of Approval No. 18 <br /> requires the applicant to submit an annual engineer ' s report on <br /> the project ' s permit compliance status. <br /> The most recent report was prepared by project engineer Lawrence <br /> Deimler, and it was submitted to the Planning Division on January <br /> 4, 1988. The report first was presented to the Planning <br /> Commission on March 3 , 1988 . The Planning Commission granted the <br /> continuance requested by Linden Aggregates, Inc. , and rescheduled <br /> the report for review at its meeting of April 21 , 1988 . <br /> In preparation for the April 21 , 1988 , meeting, staff has worked <br /> with the applicant to determine if the project is in compliance <br /> with the Conditions of Approval . In reviewing the Conditions of <br /> Approval, staff concluded that certain Conditions of Approval are <br /> no longer appropriate for EP-81-9. The remainder of this report <br /> updates the project 's compliance status and discusses the pro- <br /> posed modifications. <br />
