EP-81-9 OF ROSS PURVIANCE TO REVIEW THE ANNUAL PERMIT COMPLIANCE REPORT AND TO CONSIDER MODIFICATION OF THE CONDITIONS OF APPROVAL ---------------------------------------------------------------- RECOMMENDATION: Staff recommends that the Planning Commission: 1 . Approve a Negative Declaration and direct the Clerk to file a Notice of Determination; and 2 . Modify Conditions of Approval No. 4, 5 , 9, 10, 11 , and 14; and delete Conditions of Approval No. 19, 23 , and 24(g) , as noted in the staff report . BACKGROUND: Quarry Excavation Permit No. EP-81-9, as revised in January 1985 by the Planning Commission, was approved for a site located on the east side of Waverly Road, approximately one-half mile south of Shelton Road, east of Linden. Condition of Approval No. 18 requires the applicant to submit an annual engineer ' s report on the project ' s permit compliance status. The most recent report was prepared by project engineer Lawrence Deimler, and it was submitted to the Planning Division on January 4, 1988. The report first was presented to the Planning Commission on March 3 , 1988 . The Planning Commission granted the continuance requested by Linden Aggregates, Inc. , and rescheduled the report for review at its meeting of April 21 , 1988 . In preparation for the April 21 , 1988 , meeting, staff has worked with the applicant to determine if the project is in compliance with the Conditions of Approval . In reviewing the Conditions of Approval, staff concluded that certain Conditions of Approval are no longer appropriate for EP-81-9. The remainder of this report updates the project 's compliance status and discusses the pro- posed modifications.
