At that hearing the Regional Board concluded that it was
appropriate, after considering the factors in CWC section 13385,to assess civil liability in the amount of
$80,000,with 50 percent going towards an acceptable supplemental environmental project (SEP). It
continued the hearing to a later date to allow for consideration of an alternative SEP to that already
proposed. At the continued hearing, the Regional Board will consider the proposed SEP.
In order to conserve resources, this letter transmits paper copies of the tentative Administrative Civil
Liability Order and Notice to the Discharger only. Interested persons may download the proposed
Administrative Civil Liability Order, proposed supplemental environmental project (SEP), and Notice
from the Regional Board's Internet website at
http://www.waterboards.ca.gov/centralvalley/tentative/index.html. Any comments or recommendations
you may have regarding the proposed SEP must be submitted to this office by 17 October 2005 in order
for us to give them full consideration prior to the meeting of the Regional Board.
California Environmental Protection Agency
0 Recycled Paper
