WASTE DISCHARGE REQUIREMENTS <br /> CITY OF TRACY <br /> WASTEWATER TREATMENT PLANT <br /> SAN JOAQUIN COUNTY <br /> a. Implement the necessary legal authorities as provided in 40 <br /> CFR 403.8(f) (1 ) ; <br /> b. Enforce the pretreatment requirements under 40 CFR 403.5 and <br /> 403.6; <br /> C. Implement the programmatic functions as provided in 40 CFR <br /> 403.8(f) (2) ; and <br /> d. Provide the requisite funding and personnel to implement the <br /> pretreatment program as provided in 40 CFR 403.8(f) (3) . <br /> 6. If the flow regime in Old River is significantly altered from <br /> present conditions, or if in further defining the flow it is found <br /> that the flow regime is significantly different from that used as <br /> a basis for effluent limits, then this permit may be reopened for <br /> modification and addition of effluent limits and requirements. <br /> 7. In order to determine the flow regime in Old River, the Discharger <br /> is required In Monitoring and Reporting Program No. 91-055 to <br /> continuously monitor the flow of Old River. To Discharger shall <br /> comply with this monitoring requirement on the following time <br /> schedule: <br /> Task Compliance Date <br /> Submit Proposed Monitoring Scheme 12 April 1992 <br /> Begin Implementation/Construction 7 June 1992 <br /> Achieve Full Compliance 26 July 1992 <br /> 8. The Discharger shall submit annually a report to EPA and the Board <br /> describing the Discharger's pretreatment activities over the <br /> previous 12 months. In the event that the Discharger is not in <br /> compliance with any conditions or requirements of this permit, the <br /> Discharger shall include the reasons for noncompliance and state <br /> how and when the Discharger shall comply with such conditions and <br /> requirements. This annual report is due on 31 January of each <br /> year and shall contain, but not be limited to, the items listed in <br /> Section G. of the Standard Provisions and Reporting Requirements <br /> (NPDES) . <br /> 9. If it is found that the Discharger is cannot achieve substantial <br /> compliance with either Effluent Limit B.7. or Receiving Water <br /> Limit E.8 (Thermal Plan Requirements) , a study will be required to <br /> assess the receiving water impacts. Potential actions undertaken <br /> by the Regional Board after analysis of the receiving water study <br /> may include reopening the permit to adjust permit limits and/or <br /> requesting a waiver of the Thermal Plan requirements. <br />
