.i <br /> WASTE DISCHARGE REQUIREMENTS <br /> CITY OF TRACY <br /> SAN JOAQUIN COUNTY -6- <br /> 6. The discharge shall not cause bottom deposits in the receiving waters. <br /> 7. The discharge shall not increase the turbidity of the receiving waters by <br /> more than 10% over background levels. <br /> 8. The discharge shall not alter the normal ambient pH of the receiving water <br /> more than 0.5 units. <br /> 9. The discharge shall not increase the normal ambient temperature of the <br /> receiving water more than 5°F (3'C) . <br /> 10. The discharge shall not cause floating or suspended materials in the <br /> receiving waters. <br /> 11. The discharge shall not cause a violation of any applicable water quality <br /> standard for receiving waters adopted by the Board or the State Water <br /> Resources Control Board as required by the Clean Water Act and regulations <br /> adopted thereunder. If more stringent applicable water quality standards <br /> are approved pursuant to Section 303 of the Clean Water Act, or amendments <br /> thereto, the Board will revise and modify this Order in accordance with <br /> such more stringent standards. <br /> G. Provisions: <br /> 1. Before exceeding 5.5 mgd, the Discharger shall submit a certification <br /> signed by a California registered civil engineer, certifying that the plant <br /> is capable of meeting waste discharge requirements for flows to 9.0 mgd. <br /> 2. Neither the discharge nor its treatment shall create a nuisance or pollu- <br /> tion as defined in Section 13050 of the California Water Code. <br /> 3. The Discharger shall comply with all the items of the "Standard Provisions <br /> and Reporting Requirements (NPDES)" , dated 1 August 1984, which are part <br /> of this Order. <br /> 4. The Discharger shall comply with all pretreatment requirements contained <br /> in 40 CFR Part 403 and shall be subject to enforcement actions, penalties, <br /> fines and other remedies by EPA or other appropriate parties, as provided <br /> in the Clean Water Act, as amended. The Discharger shall implement and <br /> enforce its approved Publicly-Owned Treatment Works Pretreatment Program <br /> which is hereby made an enforceable condition of these requirements. EPA <br /> may initiate enforcement action against an industrial user for noncom- <br /> pliance with applicable standards and requirements as provided in the <br /> Clean Water Act. <br /> 5. The Discharger shall enforce the requirements promulgated under Sections <br /> 307(b) , (c) , (d) , and 402(b) of the Clean Water Act. The Discharger shall <br /> cause industrial users subject to federal categorical standards to achieve <br /> compliance no later than the date specified in those requirements or, in <br /> the case of a new industrial user, upon commencement of the discharge. <br />
