_O... lr <br /> CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> ORDER NO. 79-123 <br /> AMENDMENT OF CEASE AND DESIST ORDER NO. 78-52 <br /> FOR <br /> CITY OF TRACY <br /> WASTEWATER TREATMENT FACILITY <br /> SAN JOAQUIN COUNTY <br /> The California Regional Water Quality Control Board, Central Valley Region, (here- <br /> inafter Board) finds that: <br /> 1. The Board adopted Cease and Desist Order No. 78-52 on 28 April 1978 contain- <br /> ing a prohibition of wet industry connections. <br /> 2. The Board adopted Cease and Desist Order No. 79-54 on 23 February 1979 as a <br /> supplement to Order No. 78-52. This second Order established a time schedule <br /> to comply with specific effluent limitations and set interim BOD and Suspended <br /> Matter concentrations for the discharge. <br /> 3. The City of Tracy has requested allowance to connect a wet industry, giving <br /> assurance it can meet the interim BOD and Suspended Matter concentrations <br /> specified in Order No. 79-54 and all other limitations contained in Waste <br /> Discharge Requirments Order No. 77-182. <br /> 4. Issuance of this Order is exempt from the provisions of the California <br /> Environmental Quality Act pursuant to Section 2714(h)(2), Chapter 3, <br /> Title 23 of the California Water Code. <br /> 5. The Board on 25 May 1979, in Fresno, held a hearing and considered this <br /> matter after giving interested persons an opportunity to present evidence <br /> concerning the amendment. <br /> IT IS HEREBY ORDERED THAT, pursuant to Section 13301 of the California Water Code, <br /> Order No. 78-52 is amended as follows: <br /> 1. The City of Tracy may accept year-around discharge to the City sewerage <br /> system from a proposed wet industry facility, provided, however, that: <br /> a. The additional discharge to the system shall not exceed 23,000 <br /> gallons per day. <br /> b. The additional discharge to the system shall be limited to a 30-day aver- <br /> age of 57 pounds per day each of 5-day BOD and Suspended Matter. <br /> I, JAMES A.
