Inadvertent Discoveries Mitigation Measure — No Tribal Monitor <br /> The following mitigation measure applies to CEQA Guidelines section 15370 and is intended to <br /> address inadvertent discoveries made by construction personnel , agencies , or consultants at the <br /> work site when no archaeological or tribal monitor is present during ground disturbing activities . <br /> If potential tribal cultural resources (TCRs) and/or archaeological resources are discovered <br /> during ground disturbing construction activities , all work shall cease within 100 feet of the find <br /> (or an appropriate distance based on the apparent distribution of the TCR) . A Tribal <br /> Representative from traditionally and culturally affiliated Native American Tribe that has <br /> engaged in consultation for the Project will assess the significance of the find and make <br /> recommendations for further evaluation and treatment as necessary . Culturally appropriate <br /> treatment may include , but is not limited to : processing materials for reburial , minimizing <br /> handling of cultural objects , leaving objects in place within the landscape , or returning objects to <br /> a location within the Project area where they will not be subject to future impacts . The United <br /> Auburn Indian Community (UAIC ) of the Auburn Rancheria does not consider curation of <br /> objects or soils from TCRs to be appropriate or respectful and requests that materials not be <br /> curated , unless requested by the Tribe . <br /> Treatment that protects , preserves or restores the integrity of a TCR may include Tribal <br /> Monitoring , recovery of cultural objects , and reburial of cultural objects or cultural soil that is <br /> done in a culturally appropriate manner as identified by Tribal Representatives . <br /> Recommendations for the treatment of a TCR will be documented in the project record by the <br /> lead agency representative . For any recommendations made by traditionally and culturally <br /> affiliated Native American Tribes that are not implemented , a justification for why the <br /> recommendation was not followed will be provided in the project record by the lead agency <br /> representative . <br /> If substantial adverse change to the significance of TCRs , unique archeology , or other cultural or <br /> archaeological resources occurs , then consultation shall commence with the UAIC and other <br /> traditionally and culturally affiliated Native American Tribes that have requested consultation . <br /> In order to coordinate for compensation for the impact to a TCR, the Tribal consultation will be <br /> regarding mitigation contained in the Public Resources Code sections 21084 . 3 (a) and (b) . <br /> If articulated or disarticulated human remains are discovered during ground disturbing <br /> construction activities or ground disturbing activities , all work shall cease within 100 feet of the <br /> find , and the provisions provided in the Health and Safety Code Section 7054 and Public <br /> Resources Code 5097 . 98 , 5097 . 99 . 5097 . 991 shall be implemented . <br /> United Auburn Indian Com -riunity <br />
