Pursuant to Development Title Section 9-1015.9, the parking requirements may be reduced by <br /> the Director if the parking requirements may be considered excessive due to the unusual nature <br /> of the establishment proposed. The Community Development Department recommends <br /> approving the modification requests as proposed. All other parking requirements will still be <br /> required in conformance with Development Title Chapter 9-1015, and all requirements for ADA <br /> (Americans with Disabilities Act) parking shall be met. <br /> Williamson Act <br /> The proposed site is currently under the California Land Conservation Act and is subject to <br /> Williamson Act contract No. 70-C1-112. The contract restricts development to uses that are <br /> compatible with the Williamson Act and Development Title Section 9-1805. "Compatible use" as <br /> defined in the Williamson Act includes uses determined by the County to be compatible with the <br /> agricultural, recreational, or open-space use of land within the preserve and subject to contract. <br /> (Government Code Section 51201[e]) Development Title Section 9-1810.3(1)(X) states that a <br /> commercial stable is a compatible use on contracted land. <br /> Additionally, pursuant to Government Code Section 51238.1, uses approved on contracted lands <br /> shall be consistent with the Williamson Act Principles of Compatibility. The Community <br /> Development Department recommends that the proposed Principles of Compatibility, can be made <br /> in the affirmative (Attachment E, Williamson Act Principles of Compatibility). <br /> United Auburn Indian Community <br /> The United Auburn Indian Community (UAIC) submitted a letter dated August 6, 2019, which <br /> stated concerns that the proposed project may have the potential to impact cultural sites, and <br /> requested copies of any archaeological reports. This letter is a standard letter from UAIC, and <br /> Community Development Department staff spoke with a UAIC representative to ensure their <br /> concerns were met. Based on discussions with the UAIC representative, the following condition <br /> has been included in the recommended Conditions of Approval: <br /> 6.a. A construction worker tribal cultural resources awareness brochure shall be distributed <br /> by the project manager to the construction workers before any construction activities <br /> begin on the project site. <br /> This brochure will be provided to the applicant prior to issuance of any building permit. <br /> Planning Commission Staff Report, Item #2 12/19/2019— PA-1900129 (UP) 6 <br />
