PA-1900044 OF BOB PANELLA (C/O MICHAEL <br /> HAKEEM) (APN: 003-090-12, -11) (ADDRESS: 23000 NORTH DAVIS ROAD, <br /> LODI) <br /> The applicant has submitted the above referenced Variance application to vary the minimum <br /> required front yard setback for a ten(10)foot tall closed fence in the AG-40(General Agriculture, 40- <br /> acre minimum)zone from thirty(30)feet to 1.5 feet <br /> The General Plan designation of the parcel is A/G (General Agriculture) and the zoning is AG-40 <br /> (General Agriculture, 40-acre minimum). <br /> The project site is located on the northeast corner of North Davis Road and West Peltier Road, Lodi. <br /> The Community Development Department has reviewed the above-referenced application and <br /> offers the following comments: <br /> Background <br /> On November 15, 2018, the Community Development Department opened Code Enforcement <br /> case No. EN-1800486 for the construction of a solid fence on the front property line. On March 7, <br /> 2019, the applicant submitted Variance application No. PA-1900044 to vary the minimum required <br /> front yard setback for a ten (10) foot tall closed fence in the AG-40 (General Agriculture, 40-acre <br /> minimum)zone from thirty(30)feet to 1.5 feet. <br /> Findings <br /> In order to approve the Variance application, the Planning Commission is required to make three <br /> (3)findings regarding special circumstances, no special privileges, and if the use is authorized in <br /> the affirmative pursuant to Development Title Section 9-827.5. <br /> Finding 1: Special Circumstances <br /> Because of the special circumstances applicable to the property, including size, shape, topography, <br /> location, or surroundings, the strict application of the regulation deprives the property of privileges <br /> enjoyed by other property in the vicinity and under identical zoning classification. <br /> I <br />
