Analysis <br />Background <br />At the November 15, 2018, Planning Commission hearing, a neighbor to the 7609 E Northland Road, <br />Manteca (the "Property") spoke during public comment. The neighbor stated that the permitted truck parking <br />and its associated noise, have negatively affected their quality of life. In response to the neighbor's <br />comments, the Planning Commission directed Community Development Department staff to prepare a <br />report on the land use entitlement history of the Property. <br />On November 21, 2018, staff met with two (2) neighbors regarding their concerns. During that meeting, <br />staff informed the attending neighbors that a report would be given at the Planning Commission meeting <br />scheduled for December 20, 2018. <br />On December 20, 2018, staff provided a report to the Planning Commission. Neither the property owner <br />nor the neighbors were in attendance at the meeting. The Planning Commission did not provide any further <br />direction. <br />Enforcement & Land Use History <br />Between January and March of 2016, six (6) complaints about truck parking without a land use permit on <br />the Property were received and entered into the Community Development Department's Code Enforcement <br />system. Each complaint was investigated and on February 17, 2016, Enforcement Case No. EN-1600032 <br />was opened. The Enforcement Officer informed the property owner of the violation. An inspection of the <br />site was conducted again on March 30, 2016 and all trucks had been removed. As a result, the case was <br />closed. <br />On July 11, 2016, the Property owner applied for Site Approval application No. PA-1600172 for agricultural <br />truck parking to include the parking of one (1) truck and two (2) trailers on the property. On November 16, <br />2016, the planning application was approved. On September 18, 2017, the owner applied for Building <br />Permit No. BP-1703692 for grading for an agricultural truck parking facility. On November 17, 2017, the <br />building permit was finaled and the use was established. <br />Between April of 2016, and March of 2018, no complaints were received by the Department. <br />Between April of 2018 and December of 2018, nine (9) complaints were received regarding the number of <br />trucks parked on site exceeding the approved land use permit, noise generated by the trucks, and parking <br />of STAA trucks on site STAA trucks are a defined size of truck that are only allowed to drive on approved STAA <br />routes. Northland Road is not an approved STAA route. <br />On October 31, 2018, Enforcement Case No. EN-1800461 was opened for "violation of the existing land <br />use permit by parking more than 1 truck and/or 2 trailers on site." On October 31, 2018, a Notice of Violation <br />and Order to Abate was mailed to the property owner, with a re-inspection date scheduled on December 7, <br />2018. The property owners contacted the officer and were informed of what previously approved Site <br />Approval No. PA-1600172 permitted on site. On December 7, 2018, the enforcement officer conducted a <br />follow up site visit, and there was only one (1) trailer on site. The enforcement case was closed on this <br />date. <br />On April 22, 2019, Enforcement Case No. EN-1900147 was opened for "violation of existing land use permit <br />by parking more than 1 truck and/or 2 trailers on site." On April 24, 2019, a Notice of Violation and Order <br />to Abate was mailed to the property owners, with a re-inspection date of May 24, 2019.
