<br /> As Mr. O'Neill indicated in his letter dated November 24, 2008, work.at this site
<br /> had been hampered by delays in payment and reimbursement for work performed in
<br /> 2006, 2007, and through the first three quarters of 2008. As a result of these delays,
<br /> Upgradient had not received payment for monitoring services (as well as remediation
<br /> services)performed during the previous 10 calendar quarters and was forced to inform ' '
<br /> Mr. O'Neill in October 2008 that we would not be able to accrue additional,laboratory
<br /> and other charges until those earlier charges had been paid. Therefore, no monitoring or
<br /> sampling was done at Valley Motors during the fourth quarter.
<br /> Although no.field work was performed, Mr. O'Neill directed Upgradient
<br /> personnel to contact representatives of the State UST Cleanup Fund and the Regional
<br /> Water Quality Control,Board in early November to determine when reimbursement might
<br /> be forthcoming and to discuss potential alternative approaches to site investigation and/or
<br /> cleanup. These conversations and a first draft of a work plan to perform a groundwater
<br /> pumping test constituted the extent of our activities during the quarter. We are now in the
<br /> process of revising that draft mork plan in light of the discussions that took place with
<br /> EHD personnel in your offices during our February 6, 2009 meeting.
