Upgradien Environmental C rLsultants
February 24, 2009
EVMr. Michael Infurna l
Environmental Health Department
600 E."Main N At? tity 2 2009
Stockton, CA 95201 ENVR NI,IEN T 1-1:EALTH
• Subject: Valley Motors PERMi j/SFAVICES•
Fourth Quarter 2008 Report
Dear Mr. Infurna: ,
a..Auhe,rebuest:oflmr, Tom.-O 6111-of-Palley:Motors,-Lpgradient-Ervirenmenta? -- -
__ _ Consultants has prepared this letter in lieu of a formal report for the 4th quarter of 200,8.
R
As Mr. O'Neill indicated in his letter dated November 24, 2008, work.at this site
had been hampered by delays in payment and reimbursement for work performed in
2006, 2007, and through the first three quarters of 2008. As a result of these delays,
Upgradient had not received payment for monitoring services (as well as remediation
services)performed during the previous 10 calendar quarters and was forced to inform ' '
Mr. O'Neill in October 2008 that we would not be able to accrue additional, laboratory
and other charges until those earlier charges had been paid. Therefore, no monitoring or
sampling was done at Valley Motors during the fourth quarter.
Although no.field work was performed, Mr. O'Neill directed Upgradient
personnel to contact representatives of the State UST Cleanup Fund and the Regional
Water Quality Control,Board in early November to determine when reimbursement might
be forthcoming and to discuss potential alternative approaches to site investigation and/or
cleanup. These conversations and a first draft of a work plan to perform a groundwater
pumping test constituted the extent of our activities during the quarter. We are now in the
process of revising that draft mork plan in light of the discussions that took place with
EHD personnel in your offices during our February 6, 2009 meeting.
Si cerel
Victor B.
