CONDITIONS OF APPROVAL <br /> MS-99-17 <br /> Jacklich Trust <br /> Minor Subdivision Application No. MS-99-17 was approved by the San Joaquin County Community <br /> Development Department on October 18, 1999. The effective date of approval is October 28, 1999. <br /> This tentative map approval will expire on October 27, 2002, which is three years from the effective <br /> date of approval, unless(1)all Conditions of Approval have been complied with and (2) a Parcel Map <br /> has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Tina Wehrmeister,468-8477) <br /> a. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels and shall <br /> be in substantial conformance with the Tentative Map submitted August 18, 1999. A fee is required <br /> to process the Certificate of Compliance application. (Development Title Section 9-890.4(1)) <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 40 acres. PARK FEES: Due to the relatively small size of the subdivision,less than fifty (50) parcels, the San <br /> Joaquin County Department of Parks and Recreation will require the collection of in-lieu fees for park <br /> development as a requirement for approval of the Map. (Development Title Section 9-1230.8) <br /> 5. COUNTY COUNSEL (Staff Contact: Dee Anne Watkins,468-2980) <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision, which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br />
