In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action). <br /> The following violations have not been resolved since the issuance of the October 26,2016 routine underground storage tank(UST)inspection report: <br /> -Violation 305 (HSC 25290.1(e))-The brine level in the vent sump was several inches below the top of the sump, records on site show that brine was <br /> added to all UDC sumps on October 26, 2016, to date no return to compliance was received for this violation. In addition, although EHD was onsite <br /> during the installation of tubing inside the sumps to facilitate communication testing,to date no verification of communication inside the fill and STP sump <br /> (6 total)was witnessed by the EHD,immediately schedule this testing- <br /> -Violation 316(HSC 25290.1(c)(3), HSC 25290.2(c)(3))-On October 26,2016,water was found in the 91 STP sump,diesel STP sump,and 87 fill sump <br /> Also, on October 28, 2015, water was found in diesel STP, and on October 30, 2014 waster was found inside the diesel fill sump. A repair permi <br /> application was submitted to the EHD on 5-11-2017 to repair the 87-octane fill sump only, submit appropriate RTC documentation to address th <br /> remaining sumps. <br /> To avoid your system being red tagged seven(7)days days from the issuance of this warning letter,immediately repair all failed components and test al <br /> required components (which were not tested during the October 26, 2017) under inspection from the EHD, and submit proof of corrections/RT <br /> documentation to the EHD.
