In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action). <br /> -Facility has detected a possible leakage of interstitial monitoring fluid in the two compartment premium/diesel UST. On <br /> October 29, 2013, Xerxes technicians verified there is a 74 inch fracture located at the premium base end that connects t <br /> the diesel tank allowing the brine to weep into the diesel compartment.Xerxes technician did not repair the fracture. <br /> -Diesel primary wall is compromised.This is a violation of Health &Safety Code HSC 25209.1(c)(1), HSC 25209.2(c)(1) <br /> which states all primary containment must be constructed, operated and maintained liquid or vapor tight. <br /> -Premium secondary wall is compromised. This is a violation of HSC 25209.1(c)(1), HSC 25209.2(c)(1)which states <br /> secondary containment must be constructed, operated and maintained liquid or vapor tight. <br /> -Interstitial liquid continues to weep into diesel tank.This is a violation of HSC 25209.1(e)which states the interstitial liquid <br /> must be maintained so that a breach in either primary or secondary containment can be detected. <br /> -Fuel delivery to diesel and premium tank is prohibited. Red Tag will be removed by EHD when EHD verified the <br /> violations referenced in the"Notice of Significant Violation"has been repaired to allow UST operate within compliance <br /> and approval according to UL listing and Xerxes. Contact EHD, ph. 209-468-3420 for an inspection when the violations <br /> have been corrected. If UST is to be removed and replace, submit Permanent Closure and Installation permit applications <br /> to EHD by January 31, 2014.
