CONDITIONS OF APPROVAL <br /> MS-99-23 <br /> June W. Mello <br /> Minor Subdivision Application No. MS-99-23 was approved by the San Joaquin County Community <br /> Development Department on January 5, 2000. The effective date of approval is January 15, 2000. <br /> This tentative map approval will expire on January 14, 2000,which is three years from the effective <br /> date of approval,unless(1)all Conditions of Approval have been complied with and (2) a Parcel Map <br /> has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Kai Luoma, 468-9567) <br /> (a) LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this <br /> map: <br /> (1) All parcels shall have a minimum lot width of three hundred thirty (330) feet, measured <br /> at the front yard setback line. (Development Title Section 9-610.4) <br /> (2) Parcels 1, 2, 3, 4, and 5 shall have a minimum lot area of 80 acres. (Development <br /> Title Section 9-610.2) <br /> (b) TREE PRESERVATION: Future development on the parcels shall be consistent with the <br /> requirements of the County's Tree Preservation Ordinance. (Development Title Section 9- <br /> 1505) <br /> (c) RIPARIAN HABITAT ZONE: Parallel to Bear Creek, a natural open space area for <br /> riparian habitat and waterway protection shall be maintained to provide nesting and <br /> foraging habitat and the protection of waterway quality. The minimum width of said open <br /> space shall be one-hundred (100) feet, measured from the mean high water level of the <br /> natural bank or fifty (50) feet back from the existing riparian habitat, whichever is greater. <br /> Water-dependent uses may be permitted in this buffer. The mean high water level and the <br /> edge of the riparian habitat shall be shown on the Parcel Map. The open space buffer <br /> required above shall be shown on the parcel map with the following note: <br /> Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this <br /> area is designated as a natural open space for riparian habitat and waterway <br /> protection. No development other than water dependent uses shall be permitted in <br /> this space. <br />
