ATTACHMENT A <br /> VAN DYK,GREGORY <br /> Variance(parcel split) <br /> PROJECT DESCRIPTION <br /> Applicant Gregory Van Dyk owns approximately 21.84 acres located at 20290 E. River Rd., Ripon. The <br /> property is planted in approximately 18 acres of almond orchard. In or about 1999 Mr.Van Dyk's <br /> parents,Andrew and JoAnn, purchased the property which included a single family home located <br /> immediately south of E. River Rd. ("Residence 1",20290 E. River Rd.). They occupied this home as their <br /> primary residence until their respective deaths in 2015 and 2016. <br /> In or about 2005 Mr.Van Dyk built a single family home on the property, several hundred feet south of <br /> his parent's residence ("Residence 2"),which is identified by the street address 20306 E. River Road. <br /> Mr.Van Dyk occupies Residence 2 as his primary residence. Mr.Van Dyk has farmed the property for <br /> the past two decades. <br /> Follow the passing of his parents, Mr.Van Dyk began renting Residence 1 to a tenant. Mr.Van Dyk <br /> desires to reside on the property and to continue to farm the property, but does not desire act as a <br /> landlord for Residence 1 and the tenant has expressed a desire to purchase Residence 1 from Mr.Van <br /> Dyk. <br /> The Property is zoned AG-40,which precludes the creation of parcels less than 40 acres in size. <br /> Accordingly, Mr.Van Dyk seeks a variance pursuant Development Title Ch. 9-827 to allow the division of <br /> the property into two separate legal parcels of 2 acres(surrounding Residence 2)and 19.84 acres in size, <br /> as shown on Exhibit 1,to allow Residence 2 to be conveyed to the current tenant(or other buyer). The <br /> minor subdivision application to divide the property would follow the approval of this variance <br /> application. The variance and division of the property constitute the whole of the action to be taken as <br /> part of this project. <br /> This application does not propose any developmentāthe development has already occurred. It merely <br /> requests the ability to separate the property such that Residence 2 and the surrounding two acres may <br /> be legally conveyed. <br /> FINDINGS <br /> As required by Dev.Tit. §9-827.5 the following findings can be made in support of Mr.Van Dyk's <br /> application. <br /> 1. Special Circumstances. Because of the special circumstances applicable to the property, <br /> including size, shape,topography, location, or surroundings,the strict application of the <br /> regulation deprives the property of privileges enjoyed by other property in the vicinity and <br /> under identical zoning classification. <br /> {00165622.) <br />
