BROWN <br /> OF THE PLANNING COMMISSION'S DENIAL OF <br /> VARIANCE APPLICATION NO.VR-00-2 OF ROSS C. BROWN TRUST <br /> (FIFTH SUPERVISORIAL DISTRICT) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors uphold the Planning Commission's denial of Variance Application No. <br /> VR-00-2 and deny the appeal. <br /> BACKGROUND: <br /> The application is for a Variance to reduce the AG-40 zone minimum lot size from 40 acres to 1.8 acres <br /> and the minimum lot width from 330 feet to 242 feet to permit a Minor Subdivision appiicaiion. <br /> The Planning Commission heard this matter at its meeting of September 21,2000. <br /> After reviewing all written and oral testimony, the Planning Commission voted 7-0 to deny the Variance <br /> because the Commission could not make Findings 1 and 2 contained in the Staff Report and as required <br /> by Section 9.827.5 of the Development Title. <br /> On September 28, 2000, Ross C. Brown, representing the Ross C. Brown Trust, appealed the Planning <br /> Commission's denial of the application. <br /> 1. APPEAL STATEMENT <br /> .The purpose of this application is to split 1.8 acres from an existing 14.3 acre parcel. No land <br /> use designation change is being requested. Proposed 1.8 size was determined by minimum set <br /> back guidelines around existing building and logical parcel shape. Although not a California <br /> historical landmark,this property is the original homesite of the Cadergren Ranch, circa 1909. <br /> There are several small parcels (ranging from .51 to 1.12 acres) located approximately 500 feet <br /> from the existing western boundary. This proposed Variance allows the current property owner to <br /> share in the same privileges granted to these similar sized property owners. In addition to these <br /> smaller parcels, several less than 40 acre parcels have been created on Austin Road to the east. <br /> This variance request has no impact on current agricultural uses. The farming of almond trees will <br /> continue. Approval of this Variance will not change the use of the land,the number of homes on <br /> the land, nor the number of individual residing on the land. This Variance application does not <br /> have an impact on the environment uses nor does it impact or change the current irrigation <br /> system being used.' <br />
