During the removal activities your company demolished monitoring well 4. <br /> This is in violation of San Joaquin County Ordinance Code Sections 9-1115.3 and 9-1115.6 (copy <br /> enclosed)which require obtaining a permit from San Joaquin County Public Health Services <br /> Environmental Health Division (PHS/EHD) prior to destroying any well and authorize the adoption <br /> of well standards. The well standards require that monitoring wells be destroyed by a C-57 <br /> licensed contractor. <br /> In addition, a 300-gallon solvent UST was removed from a different area of the site on August 17, <br /> 1998. The piping associated with this UST was to be removed at a later date and soil sampling <br /> beneath the piping was to occur. On September 17, 1998, PHS/EHD staff was informed that this <br /> piping had been removed. Removal of this UST piping without sampling the soil beneath it is a <br /> violation of Health & Safety Code Section 25299.3 which authorizes the adoption of the California <br /> Underground Storage Tank Regulations(Title 23, Division 3, Chapter 16, California Code of <br /> Regulations) containing Section 2672 (d). A copy of Section 2672 (d)of the California <br /> Underground Storage Tank Regulations is enclosed. <br /> A meeting has been scheduled at 10:00 a.m. on November 10, 1998, at 304 E.
