Stockpile soil samples, UST excavation soil samples and UST <br /> excavation groundwater grab samples were collected. The analytical results of <br /> those samples were faxed to San Joaquin County Public Health Services, <br /> Environmental Health Division (PHS/EHD). After review of the sample results, <br /> PHS/EHD approved of placing the stockpiled soil back in the UST excavation. <br /> On September 17, 1998, PHS/EHD staff witnessed the excavation of <br /> contaminated soil in the area of the loading rack where piping, from the former <br /> USTs and previously operated above ground storage tanks, was located. At this <br /> time, PHS/EHD staff noted that monitoring well (MW) 4 had been demolished <br /> during the UST removal activities. In letters dated October 29, 1997 and June 4, <br /> 1998, PHS/EHD informed you that any vapor or monitoring wells that would be <br /> compromised or destroyed by excavation activities had to be destroyed under <br /> permit and inspection of PHS/EHD prior to the excavation activities. <br /> The demolition of MW4 is a violation of San Joaquin County Ordinance Code <br /> Sections 9-1115.3 and 9-1115.6 (copy enclosed) which require obtaining a <br /> f permit from PHS/EHD prior to destroying any well and authorize the adoption of <br /> well standards. The well standards require that monitoring wells be destroyed <br /> by a C-57 licensed contractor. <br /> In addition, a 300-gallon solvent UST was removed from a different area of the <br /> site on August 17, 1998. The piping associated with this UST was to be <br /> removed at a later date and soil sampling beneath the piping was to occur. On <br /> September 17, 1998, PHS/EHD staff was informed that this piping had been <br /> removed. Removal of this UST piping without sampling the soil beneath it is a <br /> violation of Health & Safety Code Section 25299.3 which authorizes the adoption <br /> of the California Underground Storage Tank Regulations (Title 23, Division 3, <br /> Chapter 16, California Code of Regulations) containing Section 2672 (d).
