110 Filbert, Stockton
During the meeting Del Monte representatives discussed interest in approaching site closure
employingilntrinsic Bioremediation and Natural Attenuation concepts. PHS/EHD staff informed
Del Monte representatives that active engineered remediation would probably be required given
the high concentrations of fuel hydrocarbons in groundwater.
The responsible parties at this site are directed to submit a workplan to PHS/EHD which
f
when implemented will characterize the extent of soil and groundwater contaminant
distribution in the subsurface at this site no later than August 15, 1999. If a final revised
work plan containing the concepts of the June 30, 1999. CH2MHILL scope of work/investigation
as agreed upon during our July 1, 1999, meeting is not submitted to PHS/EHD by August 15, i
1999. and implemented before September 15, 1999, DelMonte and PARMACEAST will not be
II in compliance with PHS/EHD directives.
As discussed with a Del Monte representative on June 25, 1999, you musfbe in compliance with
PHS/EHD directives to be eligible for reimbursement for corrective action costs by the Cleanup
Fund. Please find enclosed a Cleanup Fund form letter that cites Section 2811 (b)(3) of the UST
Cleanup Fund Regulations that requires compliance with local regulatory agency directives and a
Cleanup Fund form where the local agency confirms or rejects corrective action compliance.
Therefore, if you do not meet the August 15, 1999, submittal date and September 15, 1999
implementation date, you will be jeopardizing your reimbursement for corrective action costs by j
the Cleanup Fund.
In addition, failure to comply with PHS/EHD directives may result in referral to the San Joaquin
County District Attorney's office for formal enforcement action.
Should you have questions regarding this correspondence please contact Ron Rowe at(209) 468-
0342.
Donna Heran, REHS, Director
Environmental Health Division
?,dVV J VV', 'iY1 L
Ronald Rowe, Sr. REHS Margaret agaric, Supe
LOP/Site Mitigation Unit Site Mitigation Unit
Eno,
c: SJC District Attorneys Office- David Irey
CVRWQCB - Mark List
C.H2M HILL—Elizabeth Dodge
SWRCB—Jim Munch
""Del Monte—Steve Ronzone
Geosyntex Consultants—Nancy Bice
RON/WORD/110filbert compliance letter
3
