explosion, collapse and underground. hazards. if the Work includes use of a Subcontractor, CONTRACTOR 's insurance shall also include independent contractor's coverage. { C. It is further understood and agreed that, before moving any men or materials onto the OWNER 's property , or beginning any Work , the CONTRACTOR shall deliver to the OWNER Certificates of Insurance showing the Insurance Company carrying said Workmen 's Compensation , Comprehensive General Liability , and Comprehensive Automobile Insurance, as well as the numbers Identifying said policies and their expiration dates. Said policies and certificates shall certify, among other things , that the Insurance will not be cancelled or lapse during the progress of the Mork without first giving (fifteen) 15 days ' advance notice of such cancellation or lapse to the OWNER, and that the pot ici es , i n al i respects , meet the requi rements of the Contract. In case of failure to furnish said policies or certificates of insurance or in case of cancellation of any required insurance , OWNER may terminate the employment of the CONTRACTOR. The CONTRACTOR further agrees to hold the OWNER harmless from loss or damage which might occur by reason of noncompliance with the aforesaid conditions. D. The CONTRACTOR shall. require all Subcontractors to comply with the same lams and to secure and maintain the same types , terms , and . amounts of insurance as required of the CONTRACTOR by this Article , and the CONTRACTOR shall fi.ie with the OWNER , prior to initiation of any Work at the site , certificates of such insurance for each Subcontractor. ARTICLE 14 - RISK OF LOSS - CONTRACTOR 'S PROPERTY/CONSTRUCTION MATERIAL i OWNER shall not be liable for loss or damage to any construction materials , tools , equipment , personal effects and similar items , belonging to or rented by CONTRACTOR, CONTRACTOR 's employees , Subcontractors or any person f whcrosoever, by theft or any other cause. Nor shall OWNER be liable for such f loss or damage to any materials , equipment and similar items to be installed or already installed in completed Work until final acceptance by OWNER. CONTRACTOR shall provide at his own expense any insurance required for his protection. The OWNER, CONTRACTOR and Subcontractor waive all rights of subrogation against each other, for damages caused by perils covered by 'insurance to protect the Work , except such rights as they may have to the proceeds of such insurance held by the OWNER and CONTRACTOR as trustees. AP,TICLE 15 - PROPRIETARY BRANDS AND SUBSTITUTIONS A. When two or more products are named together in the specifications , bids may be based upon any of. the products named. B. The words "or equal" in the specifications permit the bidder to propose for consideration with his bid , any one of a like materi al that is generally considered to be equal to the proprietary brand named in the specifications. However, the bidder shall base his bid on the name or make of any article , device , material , form of construction, fixture , etc. , named in the specifications whether or not the term "or equal " is used.
