Item No. 3 <br /> PC: 7-19-90 <br /> MS-90-87 <br /> Page 3 <br /> STAFF ANALYSIS <br /> POLICY CONSIDERATIONS: <br /> Background: <br /> Staff is referring this Minor Subdivision application to the <br /> Planning Commission because of letters of opposition from the <br /> Farm Bureau and from Mark Connolly of Connolly Law Office, <br /> representing Manuel Serrano, an adjoining land owner. A <br /> petition circulated by Mr. Serrano is included with the letter <br /> from Mr. Connolly. The issues raised in the letters will be <br /> addressed in this staff report. <br /> General Plan and Zoning: <br /> The site is designated as Agriculture on the General Plan and <br /> is zoned AG-40. <br /> Under Section 9-4010.2 (a) of the Planning Title: <br /> "A homesite parcel containing a minimum of one and one <br /> half (1J) acres may be created from a parcel twenty (20) <br /> acres or larger in size to finance or refinance a <br /> residence for the owner-operator. . . . " <br /> Under Sectiones 4010. 2 (b) of the Planning Title: <br /> "A homesite parcel containing a minimum of one and one <br /> half (1�) acres may be created from a parcel twenty (20) <br /> acres or larger in size to finance a residence for each <br /> member of the owner-operator's family who earns a <br /> substantial portion of his livelihood from actively <br /> participating in the farming operation, subject to the <br /> following conditions: <br /> " (1) If more than one !1) homesite parcel is to be <br /> created, the minimum parcel size of twenty (20) <br /> acres shall be increased by five (5) acres for each <br /> additional homesite parcel created; " <br /> The owner, Vix: `pia Martins, states the following in the Minor <br /> Subdivisicn -3pplication: <br /> 1. clhe is creating the owner-operator homesite (Parcel 1) <br /> to finance a residence for herself. <br />
