Analysis <br /> Application Processing <br /> Mr. Celle was attempting to convert his Produce Stand to a Farm Market. To do so, his application would need <br /> to be processed and approved before May 25, 2000, the effective date of the new Produce Stand ordinance. <br /> The Community Development Department did not receive a complete application for processing from Mr. Celle <br /> until May 19,2000,which was six days prior to the effective date of the"new regulations." Consequently, SA-00- <br /> 25 is being reviewed as a Small Agricultural Store. Applications for Produce Stand conversions that would be <br /> approved before May 2e would fall under the Farm Market use type per the `old regulations." Applications that <br /> would be approved after May 25th would fall under the Small or Large Agricultural Store use type per the `new <br /> regulations." <br /> Reason for Planning Commission Review <br /> Because the applicant missed his window of opportunity to be considered as a Farm Market under the "old <br /> regulations,"he is requesting to have 500 square feet of retail sales area in a Small Agricultural Store. The <br /> recently approved Produce Stand ordinance permits only 150 square feet of retail sales for Small <br /> Agricultural Stores. The applicant's request stems from the fact that the business across the street(SA-00- <br /> 13, located at 5477 E. Waterloo Road ) was approved as a Farm Market under the "old regulations,"and it <br /> was mistakenly allowed to have 500 square feet of retail sales. <br /> In applying structure and retail area size requirements for the first time, staff made an error by incorrectly <br /> specifying the amount of retail sales area for a Produce Stand that had converted to a Farm Market. The <br /> Development Title prior to May 25, 2000, (a.k.a. the "old regulations")did not limit the sales area used for <br /> "food products"within a Farm Market. <br /> Alternatives <br /> In order to make a finding of Consistency with the General Plan, the current Development Title standards <br /> must be followed. Current development standards include a maximum of 150 square feet for retail sales <br /> items in Small Agricultural Stores. The applicant may apply for a Use Permit to become a Large Agricultural <br /> Store by paying the additional application fee if he wishes to have a maximum of 500 square feet for retail <br /> sales. <br /> i <br /> San Joaquin County SA-00-25/Celle r <br /> Community Development Page 3 <br />
