Analysis <br /> On September 2, 1994, the applicants filed Site Approval Application No. SA-94-38 for a church and retail <br /> sales of used items. At the time the application was filed, the applicants had already established the use <br /> without benefit of any of the required permits. <br /> On October 27, 1994, the Community Development Department denied the Site Approval application <br /> based upon the inability to make the fourth of five required findings for approval. That finding deals with <br /> public health and safety, both of which were found to be significantly and adversely affected by the <br /> outdoor storage of furniture, appliances, and other debris, and the illegal use of the building in violation <br /> of the Uniform Building Code's occupancy and exiting requirements. The applicant had earlier been given <br /> the opportunity at a Development Committee meeting to delay action on the application for 30 days to <br /> permit a cleanup of the site and to resolve the noted Building Code violations. No action was taken by <br /> the end of 30 days, and the application was subsequently denied. <br /> On November 3, 1994, the applicant filed an appeal of staff's denial, which was granted by the Planning <br /> Commission on March 16, 1995. Prior to the Planning Commission hearing, the applicants removed <br /> material stored outside and temporarily resolved Building Code violations;thus, staff notified the applicant <br /> that the public health and safety finding could now be made in the affirmative. Because the church had <br /> already been established without benefit of the required permits, the Conditions of Approval adopted by <br /> the Planning Commission included specific deadlines for submittal of the required building permits and <br /> Business License and numerous required site improvements. The deadlines for meeting other conditions <br /> were August 1, 1995, and October 1, 1995. The Site Approval expiration date was September 24, 1996. <br /> On July 17, 1996, the Department sent the applicant a courtesy letter to inform him that the Site Approval <br /> was about to expire on September 24, 1996. On September 24, 1996, the applicant filed a Time <br /> Extension application. Because the applicant needed to file a Revisions of Approved Actions application <br /> instead, he was notified by telephone and letter on October 8, 1996, and asked to submit the required <br /> application material by October 18, 1996. The applicant failed to meet this deadline and brought in the <br /> necessary application on November 5, 1996. <br /> During this time (2 years and 3 months), the applicants continued to operate the church without benefit <br /> of the required permits. <br /> Proposed Changes <br /> The applicants are requesting the following changes: <br /> 1.f. That the requirement for installation of trash bins be changed from August 1, 1995, to August 1, <br /> 1997. <br /> 1.g. That the requirement for installation of parking lot lighting be changed from October 1, 1995, to <br /> October 1, 1997. <br /> 1.i.
