The petitions <br /> and letters of opposition addressed two concerns, outside storage and the illegal use of the building, both <br /> of which have been resolved. <br /> Outside Storage <br /> The letters of opposition state that the site has been used for the storage of furniture, appliances, vehicles, <br /> a mobile home, and other debris. This information was confirmed by staff during a field check of the site <br /> and was ultimately one of two reasons for which the application was denied. The site has since been <br /> cleaned up and the mobile home removed. The recommended Conditions of Approval include the <br /> requirement that there be no outside storage or sales if the use is approved. A field check of the site by <br /> staff on January 30, 1995, revealed that a few pieces of furniture, some debris, and several barrels were <br /> being stored near the north side of the building. The material would have to be removed in order to <br /> comply with the recommended Conditions of Approval. <br /> Illegal Use of the Building <br /> The letters of opposition also state that the church has been operating in the building on the site without <br /> the required permits and that the operator of the church has also been selling appliances and operating <br /> a 'recovery house.' The use of the building for religious assembly and appliance sales resulted in an <br /> enforcement action being filed against the property owner. The enforcement action, which deals with the <br /> failure to secure the required planning approvals and specific building code violations, is currently on hold <br /> because the required Site Approval was submitted and the building code violations have been temporarily <br /> resolved. The enforcement action will be closed if the Site Approval is approved and the Conditions of <br /> Approval are met. If the application is approved, additional building permits will be required to bring the <br /> use fully into compliance with the Uniform Building Code. The recommended Conditions of Approval state <br /> that the approval is only for use of the building as a church and for accessory retail sales. Because the <br /> church has already been established, the recommended Conditions also include specific deadlines for <br /> submittal of the required building permits and Business License. The Site Approval application for the <br /> project stated that the requested uses consisted of religious assembly and accessory retails sales. The <br /> application was processed, and the recommended Conditions of Approval were developed based only <br /> on those two proposed uses.
