SA-94-38 OF JACK JOSEPH <br /> FETZER (C/O LEWIS STALLWORTH) <br /> ----------------------------------------------------------------- <br /> The request is for a Site Approval application to establish a <br /> church with accessory retail sales of used items for fund raising <br /> in an existing building. The project site is located on the <br /> northeast corner of Waterloo Road and Auto Avenue in east Stockton. <br /> The project is proposed to be served by existing public water and <br /> sewage systems (operated by Cal Water and the City of Stockton, <br /> respectively) and terminal storm water drainage. <br /> The Development Services Division has reviewed the above-referenced <br /> application and conducted a field check of the subject parcel on <br /> September 22 , 1994 . Based upon the results of that field check <br /> (which indicated that the property is currently in use and being <br /> used for extensive outside storage of furniture, appliances, <br /> vehicles, and a mobile home) , comments received from the <br /> Environmental Health Division of Public Health Services, and <br /> significant opposition to the project from property owners in the <br /> vicinity, the Development Services Division intends to delay taking <br /> an action on the property for thirty days from the date of this <br /> memo. The purpose of the delay is to allow the applicant to comply <br /> with the Code requirements noted by Public Health Services and to <br /> remove all material stored outdoors on the parcel. Failure to meet <br /> these requirements will likely result in the application being <br /> denied, based on the inability to make the required Finding that <br /> the proposed use is not a threat to public health, safety, and <br /> welfare. If the application is denied, that action may be appealed <br /> to the Planning Commission by the submittal of a completed appeal <br /> form, by the applicable deadline, and an appeal fee, currently <br /> $275. If at the end of the thirty-day period these requirements <br /> have been met, the Site Approval will be processed and the <br /> following tentative Conditions of Approval will be applicable. <br /> Unless otherwise specified, all the Conditions of Approval and <br /> Ordinance Requirements shall be fulfilled prior to the issuance of <br /> any building permits and prior to the initiation of the use. <br />
