It is my understanding that your intent is for claim <br /> number 18649 is to replace claim number 9902; however, the following additional information is needed: <br /> • We need something in writing from claimant stating the intent to replace claim #9902 (currently a <br /> Priority D Claim) with claim #18649 (a higher Priority C Claim) . <br /> • Claimant has multiple claims filed with the Fund and may only have one name, address and tax I.D. <br /> number that must match in multiple claims. Thus, we request that you complete the enclosed address <br /> change form so that all claims filed under your name (Claims #9901, #9902, & 18649) are consistent. <br /> Other claims list claimant's name as Crystal Cream & Butter. It appears they should have included <br /> Company after the name (as in the new claim #18649). Those other claims also have a different <br /> contact person listed on page. one of the claim application, and are signed by someone other than <br /> Mike Newell (as on the new claim #18649). A brief letter requesting these changes along with the <br /> address change form will correct this problem (it should be signed by an officer of the company). <br /> • It is unknown claimant' s affiliation with the person that signed the new claim application (Mike <br /> Newell). Claimant must provide an "original signed" Verification and Signature Page including <br /> signatory's title as related to the claimant (preferably an officer of the company or someone <br /> designated by an officer of the company in writing to do so). <br /> In the past the Cleanup Fund allowed claimants to designate a representative to sign certain Fund <br /> documents. However, there is a concem that this procedure is not consistent with section 25299.55 of <br /> the Health and Safety Code, which requires a Fund claimant to make a sworn verification of the claim <br /> and certification of costs . Therefore, the "Authorized Representative Designation Form ' is no longer <br /> being used by the Fund and we will not accept any future documents signed by the representative that <br /> was designated by such form. <br /> We encourage claimants to sign all Fund documents personally. However, there may be <br /> circumstances where a claimant wants a representative to be able to sign Fund documents on the <br /> claimant's behalf. In this situation, the claimant must submit a notarized Power of Attorney form <br /> designating a specific representative to sign and submit documents to the Fund on the claimant's <br /> California Environments/Protection Agency <br /> �d ReereledPnper <br />
