Marigold Shell 10)ECE ED
6131 Pacific Avenue 11 V
Stockton, California 95207 SEP 1 6 2010
September 14, 2010 ENpERM1THEALTHENT
JS RVICES
Mr. Garrett Backus, REHS
Senior Registered Environmental Health Specialist
San Joaquin County Environmental Health Department
600 East Main Street
Stockton, California 95202-3029
Reference: Inspection of Marigold Shell, 6131 Pacific Avenue, Stockton
Inspection Date: August 17, 2009
Dear
Mr. Backus,
The following attachments and comments are in response to your inspection of
my facility. Please feel free to contact me for any additional information.
Code #5 —CCR 2632 (b) — An updated Monitoring and Emergency Response
Plan is again, attached as per your request. Please see my response letter from
last year addressed to you with the on-site Monitoring Plan attached. I was not
notified that this plan was not approved or insufficient. In an effort to reduce my
site overhead I discontinued utilizing a remote monitoring service. I personally
verify the Monitoring System is working daily and maintain a log. All alarms are
documented. Please let me know if this procedure is not acceptable.
Code #10 — CCR 2632 (c)(2) and Code #12 — HSC 25291(b) — I was unaware of
the failure of the gasoline tank annular sensors to activate an audible or visual
alarm. As you are aware, the technician restored the system to proper operation.
I will be more observant of repairs made to the Monitoring System.
Code #23c — CCR 2715 (c)(e) — The Designated Operator has corrected the two
dates erroneously entered on the July and August 2010 inspection reports for
Secondary Containment testing. The DO inadvertently took the turbine sump
retest date as the actual original test date for these two months. Corrected
Inspection Forms are attached. The Secondary Containment system was
retested on August 27, 2010 with passing results.
Sincerely,
Hung hanh Tran
Owner
