FINDINGS FOR MINOR SUBDIVISION <br /> PA-1900277 <br /> MOUNTAIN HOUSE INVESTORS, LLC/MACKAY&SOMPS <br /> 1. The proposed subdivision is consistent with the General Plan, any applicable Master Plan, Specific <br /> Plan, and Special Purpose Plan, the Public Financing Plan and any other applicable plan adopted by <br /> the County. <br /> This finding can be made because the analysis conducted by the Community Development <br /> Department (CDD) has shown that the proposed subdivision is consistent with all applicable <br /> adopted plans (as proposed for amendment). <br /> 2. The design or improvement of the proposed subdivision is consistent with the General Plan and any <br /> applicable Specific Plan or Special Purpose Plan. <br /> This finding can be made since the analysis conducted by the Community Development <br /> Department has found that the design or improvements of the proposed subdivision, as shown <br /> on the Tentative Map, is consistent with the General Plan, (amended) Master Plan, and <br /> (amended) Specific Plan III. <br /> 3. The site is physically suitable for the type of development proposed. <br /> This finding can be made because the sites are physically suitable to accommodate the <br /> proposed residential and open space uses. This analysis is based on the improvements <br /> proposed; the assessment of the hydrology and water quality of the site. <br /> 4. The site is physically suitable for the proposed density of development. <br /> This finding can be made because the area proposed for development is adequate in size to <br /> accommodate the density of development,consistent with the Master Plan (as amended for the <br /> project) Specific Plan III and Development Title, as amended. <br /> 5. Neither the design of the subdivision nor any proposed improvements are likely to cause substantial <br /> environmental damage or substantially and avoidably injure fish or wildlife or their habitat. <br /> This finding can be made because the proposed subdivision,as conditioned,would be required <br /> to comply with applicable Federal and State laws for the protection of fish or wildlife or their <br /> habitat (e.g., Section 401 of the Clean Water Act; Section 404 of the Clean Water Act; Federal <br /> and State Endangered Species Acts), and because the applicants would participate in the San <br /> Joaquin County Multi-Species Habitat Conservation and Open space Plan (SJMSCP). The <br /> proposed subdivision would also be subject to the Mountain House community monitoring and <br /> mitigation monitoring programs. <br /> 6. The design of the subdivision or type of improvement is not likely to cause significant public health <br /> problems. <br /> This finding can be made because the design of the minor subdivision, as conditioned would <br /> either have no impact or less than significant impact on the health of future residents. <br /> 7. The design of the subdivision or the types of improvements will not conflict with easements acquired <br /> by the public at large for access through or use of property within the proposed subdivision. <br /> This finding can be made because there are not existing public easements acquired by the <br /> public at large that will be negatively affected by the subdivision. <br /> PA-1900277 - Findings 1 <br />
