BURROUGHS CiF <br /> Deputy County Counsel <br /> RE: APPLICATION OF SEPTIC SYSTEM STANDARDS <br /> You asked me to review a deviation request for 1007 East Weatherbee Avenue, <br /> Manteca, with regard to the applicability of your division's Sewage Standards. I have <br /> reviewed the Sewage Standards and related ordinances and statutes and my opinion follows. <br /> The applicant has requested of Community Development a deviation in the rear <br /> setback requirement from thirty(30) feet to twenty-one (2 1) feet due to the location of an oak <br /> tree on the property. As a matter of routine, the request was sent to Environmental Health for <br /> review prior to action by Community Development. Your recommendation on the deviation <br /> request is not, as I understand it, an approval of the septic system on the property. That <br /> approval would come by separate application after the deviation request is approved. <br /> The information from the deviation request shows that the applicant proposes to build <br /> a new house on the property. The house would be 1800 square feet, but with no more than <br /> 1100 square feet on the ground floor. The plans show three bedrooms and an office. Ray <br /> Borges from your division reviewed the deviation request and returned it to Community <br /> Development with a notation that Environmental Health Division had no objection to the <br /> deviation request but would require a 1600+ gallon septic tank. A notation on the Land Use <br /> report that Mr. Borges reviewed states that the office is a potential fourth bedroom. It appears <br /> that Mr. Borges made that notation. <br /> A neighbor has addressed concerns to your Division regarding this new home. The <br /> neighbor has two specific concerns: (1) 1800 square feet exceeds the maximum size of a <br /> home that is allowed under your Sewage Standards for this size lot; and (2) the office could <br /> DK sm <br />
