'� � I' '�''� <br /> I am informed that the office for the proposed new home on the subject property does <br /> not contain a closet. Although there is a closet in the next room, which the neighbor contends <br /> could be made a part of the office by knocking out the wall that separates the closet from the <br /> bedroom, possible remodeling is not the standard. Therefore, the office should not be <br /> considered as a bedroom for the purposes of approving the sanitation permit when the <br /> property owner applies. <br /> The neighbor also expressed a belief that the fact that Ray Borges of your Division <br /> stated on the Deviation request that a 1600+ gallon septic tank would be required, supports <br /> her belief that the office is a fourth bedroom. Her belief is based on the fact that Section <br /> 6.1.13 of the Sewage Standards requires only a 1200 gallon tank for a three bedroom house <br /> and a 1600 gallon tank for 4 bedrooms. You have informed me, however, that it is not <br /> unusual to require a larger tank, depending upon the circumstances on a particular lot. In <br /> addition, the property owner has agreed to provide a 1600 gallon tank. This requirement of <br /> a 1600 gallon tank is not sufficient to deny the sanitation permit, when applied for, on the <br /> basis that the proposed house would have four bedrooms. <br /> The Deviation request that was referred from Community Development is not <br /> approval of the septic system. The property owner must apply for a sanitation permit pursuant <br /> to Ordinance Code section 9-1110.3. The review process for sanitation permits, according <br /> to Ordinance Code section 9-1110.4(b), is the Staff Review Procedure in Chapter 9-210. <br /> Using the Staff Review Procedure, all applications are reviewed to determine their <br /> consistency with established policies and standards. The review is of an administrative, <br /> nondiscretionary nature. The application is denied or approved based on the results of that <br /> review. (Section 9-210.2). There is no appeal from actions pursuant to Staff Review <br /> Procedure. (Section 9-210.9). <br /> In conclusion, it would be very difficult to justify a denial of a sanitation permit to this <br /> property owner. The older Sewage Standards should be applied. You should not deny <br /> the property owner the benefit of the older standards because of a typographical error <br /> in the standards that left out the word"antiquated." That error needs to be corrected <br /> in the standards to prevent future misunderstandings. The square footage on the <br /> ground level does not exceed 1,100 square feet. Again, the standards should be <br /> corrected to reflect that your concern is with the size of the ground floor of the house. <br /> Finally, the office does not have a closet and therefore, under your standards, is not <br /> a bedroom. The purpose of your standards is to insure that there is sufficient room <br /> for a safe septic system that is not a nuisance. If the proposed project on Weatherbee <br /> Avenue satisfies those purposes, it should not be denied. <br /> s �� ' <br /> 61 <br />
