WOLFE ROAD (APN 166-020-011 (VR-01-1) <br /> The City of Stockton Community Development and Public Works Departments have reviewed the <br /> subject application. The City recommends that the Variance application be denied, based upon the <br /> inability to make required findings regarding unique physical characteristics or circumstances of the site. <br /> Installation of a six-foot high masonry wall is inconsistent with the Agriculture designation on the City's <br /> General Plan Land Use/Circulation Diagram, as well as with the current agricultural use of the property. <br /> A wall of the type proposed is consistent with urban (e.g. residential) development, rather than the <br /> agricultural use of land. if it is the applicant's intent to protect the subject property from urban <br /> encroachment, then the County's Right to Farm Ordinance would appear to be a more appropriate <br /> mechanism towards that end. <br /> Should the San Joaquin County approve the subject variance, it is strongly recommended the following <br /> is included as a condition of approval: <br /> 1. The owner/developer shall enter into an agreement whereby upon future development of the <br /> subject property, the interim masonry wall shall be removed at the owner's expense. Further, <br /> any reinstallation of said wall shall be done at the owner's expense, and shall be installed in the <br /> standard location (30'frontage yard setback from ultimate right of way). <br /> 2. The San Joaquin County shall ensure the interim wall installation does not impede stopping sight <br /> distance. <br /> We appreciate the opportunity to comment on this application. <br /> JOHN CARLSON JAMES B.
