A new term
called"collection"has been added to the regulations and is defined in 14 CCR, 17225.717
(included on page 2 of this letter). Tires are considered to be in the "collection"process, as
opposed to "storage,"when they are temporarily (less than 90 days)placed in fully enclosed,
licensed road transportable containers. When tires are not being loaded or unloaded, operators
are to keep the containers closed and locked or provide a sufficient access control such as
perimeter fencing. All tires transported to and from a collection facility are to be properly
manifested. A collection operation is not required to obtain a waste tire facility permit.
Operators storing waste or used tires-in cargo boxes, seatrains, drop-off boxes or any other types
of fully enclosed movable containers do not meet the collection definition unless those
containers are stored on a licensed road transportable trailer.
If you were operating under the fully enclosed movable container exclusion, contact the
California Integrated Waste Management Board(Board)in writing by August 25,2003. Briefly
describe your methods of operation, container type, the maximum amount of tires you store,if
you believe your operation meets the definition of collection, and what action you plan to take to
secure authorization for tire storage at your facility. The infonnation you provide will help us
determine if you need a permit or meet the definition of collection.
We encourage you to contact Board staff to help you figure out which type of authorization best
fits your operation. We want-to work with you to obtain the necessary approvals. For more
information,please contact Terry Smith at(916) 341-6427 or e-mail rnai1to:tsmith@eiivmb.ca.gov.
Thanks in advance for your cooperation.
Sincerely,
Don Dier, Jr., Manager
Waste Tire Enforcement Branch
Special Waste Division
California Environmental Protection Agency
Printed on Recycled Paper
The energy challenge facing California is real.Every Californian needs to take immediate action to reduce energy consumption. For
a list of simple ways you can reduce demand and cut your energy costs, see our Web site at 1ittr/hyww.ciwmb.ca.eovl
