The granting of the Variance will not be materially detrimental to other properties or land uses in the area. <br /> We have proposed the new carport to align with the residential property out buildings and thus maximize views <br /> from the residences. <br /> 2. There are exceptional or extraordinary circumstances or conditions applicable to the property or to the intended uses that do not <br /> apply to other properties in the same zoning district in the vicinity. <br /> The California Highway Patrol' s (CHP) Mission is to prevent Loss of Life Injuries and Property Damage. <br /> In order to achieve this the CHP is accrediting its facilities to meet the International Association for Property <br /> & Evidence standards. This accreditation requires that evidence vehicles, which are now parked in open <br /> parking stalls within the secure yard be covered with a carport canopy and surrounded with an 8-foot high <br /> slatted chain link fence. This will allow the department to safeguard the chain of custody of evidence and reduce <br /> the possibility of reckless driving and drunk driving convictions from being overturned on a technicality in court, <br /> thus safeguarding county citizens. There is no un programed covered parking on site and the only open spaces <br /> are less than 20 feet from the Residential properties. The original site planning distributed nearly all the spare <br /> area to landscape buffer along the public street frontage, so there is no available land which is not against the residences. <br /> 3. The strict application of the regulation deprives the property of privileges enjoyed by other properties in the vicinity. <br /> As the nearby residents have built utility structures along their property line, the CHP <br /> would not be granted any greater benefit than the adjacent properties, in fact eight feet <br /> of landscaped area would remain between the carport and the existing security fence. <br /> The residential outbuildings appear to be about 3 to 5 feet feet from the property line without <br /> landscaping between. <br /> Page 3 of 4 <br /> Updated 08(22/2019 <br />
