Pursuant to the requirements to complete the certification,below are statements relating to each of <br /> the violations noted on the Hazardous Waste and APSA Inspection Reports. <br /> Main Terminal-2941 Navy Drive <br /> RCRA Large Quantity Hazardous Waste Generator Inspection Report <br /> 106—Failed to determine if a waste is a hazardous waste. <br /> NuStar Terminals Operations Partnership L.P. (NuStar) has revised hazardous waste management <br /> protocol, and developed a more succinct procedure to ensure appropriate characterization of all waste. <br /> 115—Failed to send generator manifest copies to DTSC within 30 days. <br /> NuStar has adopted a template for use in sending manifest copies to DTSC utilizing certified mail as the <br /> mechanism; this will allow for tracking and verification of delivery. While NuStar cannot verify that the <br /> subject manifest was sent to DTSC, we do believe it was it was appropriately transmitted. A copy of the <br /> transmittal of the manifest in question (sent on February 25, 2015) is included as Attachment 2. <br /> Main Terminal-2941 Navy Drive <br /> Aboveground Petroleum Storage Act Inspection Report <br /> 303—Failed to have a PE certify technical amendments. <br /> NuStar has carefully evaluated the applicable regulations and has conferred with the facility's SPCC <br /> Plan (Plan) certifying PE.
