Isorena of my staff reminded Mr. Hooton <br /> about the overdue work plan. Mr. Hooton stated that it is BP's belief that the methyl tertiary butyl ether <br /> (MTBE) levels reflect concentrations which are not representative of subsurface conditions at the time of <br /> the August 1994 transfer of the facility from BP to Tosco. He also stated that he has been trying to get an <br /> agreement with Tosco to address the Board's request. Mr. Isorena informed Mr. Hooton that since it was <br /> unlikely for BP to submit the investigation report on time, he should request an extension, which should <br /> include a rationale for the delay and a schedule to submit the work plan and conduct the work. We have <br /> not received an extension request. <br /> Since our initial request for a work plan did not include Tosco (past owner) and ST Services (current <br /> owner), we are reiterating our 15 February 2000 request. By 24 July 2000, please submit a work plan to <br /> determine the source of MTBE and define the lateral and vertical extent of the offsite plume. We <br /> encourage all the parties involved to come to an agreement to comply with our request.
