CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> MONITORING AND REPORTING ORDER NO. R5-2013-XXXX <br /> CALIFORNIA WATER CODE SECTION 13267 <br /> FOR <br /> ST SERVICES, L.L.C. AND NUSTAR ENERGY L.P. <br /> BULK FUEL TERMINAL #29 <br /> 2941 NAVY DRIVE, STOCKTON <br /> STOCKTON, SAN JOAQUIN COUNTY <br /> This Order is issued to ST Services, L.L.C, a subsidiary of NuStar Energy, L.P. hereafter <br /> referred to as the Discharger. The Order is issued pursuant to California Water Code <br /> section 13267, which authorizes the Executive Officer of the California Regional Water <br /> Quality Control Board, Central Valley Region (hereafter Central Valley Water Board or <br /> Board) to issue a Monitoring and Reporting Order (Order). <br /> The Executive Officer finds: <br /> INTRODUCTION <br /> 1. The Site was developed in the 1960s for use as a fuel distribution facility. NuStar <br /> currently owns and operates a bulk fuel facility at the Site. <br /> 2. ST Services and NuStar are named as Dischargers based on evidence that <br /> supports the conclusion that the groundwater pollution is the result of discharge(s) <br /> that occurred during their Site operations. NuStar is the current owner of the <br /> property where an unauthorized release of hazardous substances occurred. <br /> 3. Between 1987 and 2010, NuStar installed and sampled 41 groundwater <br /> monitoring wells and conducted numerous investigations. In 2003, NuStar <br /> removed about 400 tons of contaminated soil and liquid phase hydrocarbons <br /> (LPH) near AST 3302. Between 2003 and 2004, NuStar conducted a <br /> bioaugmentation pilot study to assess the feasibility of bioremediation at the Site. <br /> The pilot study results indicated that although the process promoted <br /> biodegradation of petroleum hydrocarbons, hydraulic control was not practicable. <br /> 4. Investigations have shown that elevated levels of total petroleum hydrocarbons as <br /> gasoline (TPHg), TPH as diesel (TPHd), benzene, toluene, ethylbenzene, and <br /> xylenes (collectively BTEX), methyl tertiary butyl ether (MTBE), and tertiary butyl <br /> alcohol (TBA) are present in groundwater beneath the Site, which flows generally <br /> to the east- southeast and is about four feet below ground surface (bgs). This <br /> pollution has impaired the beneficial use of groundwater resources at the Site. <br /> 5. This Monitoring and Reporting Order is issued by the Central Valley Water Board <br /> pursuant to California Water Code (CWC) section 13267 and is necessary to <br /> monitor groundwater pollutant plumes. <br /> 6. Existing data and information about the Site show the presence of various <br /> chemicals, including TPHg, TPHd, BTEX, TAME, MTBE, and TBA beneath the <br />
