CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD
CENTRAL VALLEY REGION
MONITORING AND REPORTING ORDER NO. R5-2013-XXXX
CALIFORNIA WATER CODE SECTION 13267
FOR
ST SERVICES, L.L.C. AND NUSTAR ENERGY L.P.
BULK FUEL TERMINAL #29
2941 NAVY DRIVE, STOCKTON
STOCKTON, SAN JOAQUIN COUNTY
This Order is issued to ST Services, L.L.C, a subsidiary of NuStar Energy, L.P. hereafter
referred to as the Discharger. The Order is issued pursuant to California Water Code
section 13267, which authorizes the Executive Officer of the California Regional Water
Quality Control Board, Central Valley Region (hereafter Central Valley Water Board or
Board) to issue a Monitoring and Reporting Order (Order).
The Executive Officer finds:
INTRODUCTION
1. The Site was developed in the 1960s for use as a fuel distribution facility. NuStar
currently owns and operates a bulk fuel facility at the Site.
2. ST Services and NuStar are named as Dischargers based on evidence that
supports the conclusion that the groundwater pollution is the result of discharge(s)
that occurred during their Site operations. NuStar is the current owner of the
property where an unauthorized release of hazardous substances occurred.
3. Between 1987 and 2010, NuStar installed and sampled 41 groundwater
monitoring wells and conducted numerous investigations. In 2003, NuStar
removed about 400 tons of contaminated soil and liquid phase hydrocarbons
(LPH) near AST 3302. Between 2003 and 2004, NuStar conducted a
bioaugmentation pilot study to assess the feasibility of bioremediation at the Site.
The pilot study results indicated that although the process promoted
biodegradation of petroleum hydrocarbons, hydraulic control was not practicable.
4. Investigations have shown that elevated levels of total petroleum hydrocarbons as
gasoline (TPHg), TPH as diesel (TPHd), benzene, toluene, ethylbenzene, and
xylenes (collectively BTEX), methyl tertiary butyl ether (MTBE), and tertiary butyl
alcohol (TBA) are present in groundwater beneath the Site, which flows generally
to the east- southeast and is about four feet below ground surface (bgs). This
pollution has impaired the beneficial use of groundwater resources at the Site.
5. This Monitoring and Reporting Order is issued by the Central Valley Water Board
pursuant to California Water Code (CWC) section 13267 and is necessary to
monitor groundwater pollutant plumes.
6. Existing data and information about the Site show the presence of various
chemicals, including TPHg, TPHd, BTEX, TAME, MTBE, and TBA beneath the
