ACCESS AGREEMENT <br /> RE <br /> C VED JUN 0' 3 <br /> This Access " <br /> Agreement (The Agreement ) is made as of May 21, 2002 by and <br /> among Valley Wholesale Drug Company and Mr. Louis E. Shoneff and/or Mrs. Audrey Shondff, <br /> 1429 West Fremont, Stockton, CA the ("Owners") in the following context: <br /> Valley Wholesale Drug Company is the owner of certain real property at 1401 <br /> West Fremont Street, Stockton, CA commonly referred to as (The "Property"). i <br /> I <br /> This Agreement is entered into in order for Valley Wholesale Drug Company <br /> through its consultants, Geological Technics 'Inc. (GTI), to perform an environmental'/T <br /> assessment, as recommended in a report prepared by GTI entitled "Monitoring Well Installation <br /> Work Plan" dated November 21, 2001-and to undertake any other activity considered necessary I' <br /> or advisable to mitigate an environmental + <br /> g y problems identified during, the� Assessment as j <br /> resulting from the operation of Valley Wholesale Drug Company facility (the "Related d <br /> Activities"), ' <br /> k <br /> Both the parties agree as follows: f <br /> The Owners hereby grant Valley Wholesale Drug Company; its contractors and,r <br /> subcontractors, permission to access the property located at 1401 W. Fremont'Street, refer"to <br /> map, for the installation and sampling of one monitoring well. Assessment includes completing <br /> the work as recommended in the work plan "Monitoring Well Installation Work Plan" and <br /> approved by San'Joaquin County Environmental Health Department. The Owners shall be given <br /> two (2) days notice prior to Designated Area being accessed for purposes of performing the <br /> work. <br /> After notice has been provided, persons authorized by Valley Wholesale Drug. <br /> Company or GTI ("Authorized Persons") .may access Designated Area for purposes of <br /> performing the Assessment. At any time,without notice to The Owner, Authorized Persons may. <br /> . l <br /> access the Designated Area for purposes of inspecting, surveying, observing, maintaining or <br /> monitoring conditions (including, but not limited to depth to groundwater,measurements and <br /> groundwater sampling) on the Designated Area related to the Assessment or the Related . <br /> i <br /> Activities. <br /> 1 <br />
