"AB2185, " as you are aware, is actually a regulatic;n <br /> tinder the Cali =is Health and Safety Code, Chapter 6.95, Divieican <br /> 20, Section 25500. The law requires businesses which handle <br /> hazardous materials in quantities greater than or equal to 55 <br /> gallon, 500 Founds, or 200 cubic feet to delete a Fzzardaus <br /> Material Eierrency Business Plan. <br /> "AB218511 is not funded by the State even though it is a State <br /> program. As Section 25513 of the California Health and Safety Code <br /> reads, <br /> "Fa ch Admi n i stari ng county or City may, upon a majority vote <br /> of the govarning body, adopt a sc'^.Iedule of fees to be <br /> collected f= each business required to submit a business <br /> plan pursuant to this chapter which is within its <br /> jurisdicticn. Me fee shall be set in an amount sufficient <br /> to pay only those costs incurred by the county or city in <br /> carrying out this &,apter." <br /> After much debate, research, and data analysis, we have reached what <br /> I feel is an equitable reans of calculating the fees. The <br /> calculation ara rased on I=g Fo2as and Short Fos and on the <br /> number of hazardous maters A l R per inventcry. We did place a cap on <br /> the mexiimaa number of haz zdcus materials. If your business handles <br /> more than 15 hazardous materials, you will only be charged for 15 <br /> hazardous materials.
