1 insofar as they are doing business in the State of California and confined to Defendant's 2 RESTAURANT activities in the County of San Joaquin and elsewhere in the State of California. 3 3. Defendant,with actual or constructive knowledge of this Injunction, only in so far as they 4 are doing business in the State of California, in the course of Defendant's RESTAURANT activities, 5 are pursuant to Health and Safety Code section 25515.6 hereby permanently enjoined from: 6 a. Failing to complete and/or submit a site map, in violation of Health and Safety 7 Code section 25505(a)(2); 8 b. Failing to submit emergency response plans and procedures for a release or 9 threatened release of a hazardous material,in violation of Health and Safety Code section 10 25505(a)(3); 11 c. Failing to provide training for all new employees and annual training, including 12 refresher courses, for all employees in safety procedures in the event of a release or threatened 13 release of hazardous material, in violation of Health and Safety Code section 25505(a)(4); 14 d. Failing to document training electronically or by hard copy and retain for a 15 minimum of three (3) years, in violation of Health and Safety Code section 25505(a)(4); 16 e. Failing to have emergency response plan and procedures,the inventory of 17 hazardous material and the site map readily available to personnel of the business or the unified 18 program agency, in violation of Health and Safety Code section 25505(c); 19 f. Failing to complete and/or submit a hazardous materials inventory for all reportable 20 materials on site, in violation of Health and Safety Code section 25506(a); 21 g. Failing to establish and implement a business plan for emergency response to a 22 release or threatened release of hazardous material, in violation of Health and Safety Code section 23 25507(a); 24 h. Failing to electronically submit a hazardous materials business plan annually to the 25 statewide information management system, in violation of Health and Safety Code section 26 25508(a)(1)(A); and 27 i. Failing to review and certify, on or before the annual due date,that the statewide 28 information management system is complete, accurate, and in compliance, in violation of Health and -2- PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
