(AGE),was approved with conditions by my letter of 8 October 2003 (See attached letter). To date <br /> the necessary investigation has not been completed. In a phone conversation on 3 March 2004, we <br /> discussed your difficulty getting eligibility to the State Water Resources Control Board Underground <br /> Storage Tank Cleanup Fund(UST Cleanup Fund) to pay for the petroleum hydrocarbon investigation at <br /> your property. It is my understanding that the primary problem is that the previous site owner <br /> (Buffalo Tank Corporation) who installed, operated and removed the USTs, filed for bankruptcy in 1993 <br /> and no longer exists. We will continue to work with you and State Board staff to obtain UST Cleanup <br /> Fund eligibility, as appropriate. Nevertheless, as the current property owner you have a responsibility to <br /> address the existing contamination and acceptance into the UST Cleanup Fund is not-a prerequisite to <br /> conducting the necessary work. Therefore, you are to complete the work proposed in your <br /> 30 September 2003 workplan, as approved in my letter of 8 October 2003, and submit the results in a <br /> report by 15 February 2005. <br /> If you have any questions regarding this letter, you may contact me at (916) 464-4615 or <br /> jbartonOwaterboards.ca.Qov. <br /> i <br /> James L.
