Rooney Governor
Secretarvjor
Environmental
Protection
October 15, 1998
To: Waste Tire Facility Operators with Revoked Exclusions from Permit
Subject: Clean Up and Abatement Order
Our June 14, 1998, letter informed you that Emergency Regulations had been flied revoking all
Exclusions for waste tire facilities. (The one exception to this ruling was for enclosed, moveable
containers.) Further, you were directed to submit a completed waste tire facility permit
application to the California Integrated Waste Mgtnt Board (CIWMB) by September 14, 1998, or
reduce your tire pile to less than 500 tires.
Because the CIWivIB did not receive your application for permit by that date you are now subject
to the attached clean up and abatement order. The order requires that you either obtain a waste
tire facility permit by the date specified or reduce your tire pile to less than 500 tires. Until such
time that you are issued a waste tire facility permit or reduce your tire pile to less than 500 tires
you are prohibited by the order from accepting any more waste tires at your facility. Failure to
comply with a clean up and abatement order may result in civil penalties in the amount of
S 10.000 per day for each violation, and additional enforcement action.
Should you have any questions concerning this order. please contact Cody Begley, Manager of
the Waste Tire Section at (916) 255-4063.
Sincerely,
4
Julie Nauman
Acting Deputy Director
Permitting and Enforcement Division
Attachment
California Environmental Protection Asency
?;` Printed on Recycled Paper
