1 <br /> (3) During the waste tire removal operation commencing <br /> 2 <br /> forthwith, the owner/operator shall ensure that open <br /> 3 <br /> flames, blow torches, or highly flammable materials, <br /> 4 <br /> including but not limited to, tire inner tubes, are not <br /> 5 <br /> stored within 40 feet of any waste tire pile. <br /> 6 <br /> (4) During the waste tire removal operation commencing <br /> 7 <br /> forthwith, treatments or methods necessary to prevent <br /> 8 <br /> or eliminate vector breeding shall be undertaken, <br /> 9 <br /> provided the control program is approved as appropriate <br /> 10 <br /> and effective by the local vector control authority. <br /> 11 <br /> (5) No part of this Clean Up and Abatement Order shall <br /> 12 <br /> be construed to preclude other fire prevention measures <br /> 13 <br /> as required by local fire authorities . <br /> 14 <br /> PLEASE TAKE FURTHER NOTICE THAT PURSUANT TO PRC SECTIONS <br /> 15 <br /> 42845 and 42850, if the above actions are not completed or <br /> 16 <br /> complied with by the specified dates, the CIWMB may petition the <br /> 17 <br /> superior court for injunctive relief to enforce this order and for <br /> 18 <br /> civil penalties in the amount of $10 , 000 per day for each <br /> 19 <br /> violation -oursuant to PRC sections 42845 and 42950 . <br /> 20 <br /> Liability for civil penalties may be imposed in a civil <br /> 21 <br /> action or may be imposed administratively pursuant to PRC section <br /> 22 <br /> 42850 et seq. <br /> 23 <br /> Further, failure to remove all of the tires by the required <br /> 24 <br /> date (December 31, 1998) may result in the CIWMB expending <br /> 25 <br /> available funds to perform any clean-up, abatement, or remedial <br /> 26 <br /> work required under the circumstances set forth in PRC sections <br /> 27 <br /> 42845 et seq. which, in the judgement of the CIWMB, is required by <br /> 4 . <br />
